Corporate Law, Partnerships and Trusts
Our most recent Corporate Law Sibergramme, by
Prof Bob Williams, was issued on 8 June 2010, and covers the following
issues:
- The legal consequences where trustees make an award of trust income or capital to a person who is not a beneficiary of the trust
- During the subsistence of a partnership, no partner can lay claim to particular partnership assets as being his sole property, for they are owned by the partners as co-owners in undivided shares
- Greater clarity as to meaning of business terms in common currency: ‘business’, ‘association’, ‘voluntary association’, ‘unincorporated association’, ‘universitas’, ‘firm’
- An aggrieved minority shareholder must choose his remedy carefully
Corporate Law, Partnerships and Trusts Sibergramme will keep you informed of developments in the law, by commenting on:
- Court cases (Constitutional, Supreme Court of Appeal, and High Court) — surveyed or commented on, within weeks (sometimes days) of the judgment date.
- Legislation — explanation of amendments, with succinct commentary; principal Acts surveyed and referred to include the Companies Act, Close Corporation Act, Trust Property Control Act, Insolvency Act, and Income Tax Act.
- Literature (journal articles, textbooks, web sites etc) — where considered helpful to law practitioners and corporate legal advisors.
